Terms of Service

1. Acceptance of Terms
By accessing or using the HyperVoice desktop application, the hypervoice.app website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
HyperVoice is a voice-to-text dictation application for Windows. The Service includes:
- HyperVoice Desktop: A locally-installed application that uses Whisper AI to transcribe speech to text on your device.
- HyperVoice Cloud (optional): An optional cloud-based post-processing service that enhances transcribed text using AI language models.
- HyperVoice Website: The hypervoice.app website for account management, billing, and product information.
3. Account Registration
To access certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security of your account credentials
- Promptly update your account information if it changes
- Accept responsibility for all activity that occurs under your account
You must be at least 13 years of age to create an account. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the Service.
4. Plans & Billing
4.1 Free Tier
HyperVoice offers a free tier that allows up to 500 transcribed words per day, with no payment method required. The free tier is available indefinitely, subject to these Terms and our fair-use policy. Daily word limits reset every 24 hours. We may adjust the free tier limits or availability with at least 30 days' notice.
4.2 Free Trial (Paid Plans)
New subscribers may be eligible for a 7-day free trial on a paid subscription plan. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan and your payment method will be charged.
4.3 Paid Subscription Plans
Paid subscriptions (e.g., Pro Monthly, Pro Annual) are billed on a recurring basis through our billing partner, Lemon Squeezy. By subscribing, you authorize us to charge your payment method at the beginning of each billing cycle until you cancel. Subscription features remain available for the duration of your active billing period.
4.4 Lifetime License
The Lifetime plan is sold as a one-time payment and is not a recurring subscription. A Lifetime license grants you continued access to the features included at the time of purchase, plus any future updates we choose to include at our sole discretion. "Lifetime" refers to the lifetime of the HyperVoice product, not your personal lifetime, and remains valid so long as HyperVoice continues to operate. A Lifetime license does not include features that are explicitly bundled with the Pro plan (e.g., HyperVoice Cloud) unless otherwise stated at the time of purchase.
4.5 Device Limits
Each account may be linked to a limited number of devices at any time:
- Free tier: up to 2 linked devices
- Pro and Lifetime: up to 3 linked devices
You can view and unlink devices from your dashboard. Unlinking a device revokes that device's access. Attempting to exceed the device limit will prevent new devices from linking until an existing device is unlinked.
4.6 Cancellation
You may cancel your paid subscription at any time from your dashboard. Upon cancellation, you will retain access to paid features until the end of your current billing period, after which your account will revert to the free tier. No partial refunds are issued for unused time within a billing cycle. Lifetime licenses are non-cancellable — see Refunds below.
4.7 Refunds
Refund requests are handled on a case-by-case basis. If you believe you are entitled to a refund, please contact us at support@hypervoice.app within 14 days of the charge.
4.8 Price Changes
We reserve the right to change our pricing for subscription plans and the free tier. If we change the price of your active subscription plan, we will provide at least 30 days' notice before the new price takes effect. Continued use of the Service after a price change constitutes acceptance of the new price. Price changes do not apply retroactively to Lifetime licenses already purchased.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others, including intellectual property rights
- Transmit malicious code, viruses, or harmful data
- Attempt to gain unauthorized access to the Service or its related systems
- Interfere with or disrupt the Service or its infrastructure
- Reverse-engineer, decompile, or disassemble the software, except where permitted by law
- Use the Service to generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Resell, sublicense, or redistribute the Service without our written consent
6. Intellectual Property
The Service, including its software, design, logos, and content, is owned by HyperVoice and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the Service except for the limited license to use it as described herein.
You retain ownership of any content you create using the Service (e.g., transcriptions). We do not claim ownership of your content.
7. Third-Party Services
The Service may integrate with third-party services, including but not limited to:
- Firebase (authentication)
- Lemon Squeezy (billing)
- OpenAI, Anthropic (optional AI post-processing)
Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services. When you provide your own API keys for third-party AI providers, you are solely responsible for compliance with those providers' terms.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, error-free, or secure
- Transcription results will be accurate or complete
- The Service will meet your specific requirements
- Any defects will be corrected
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HYPERVOICE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify, defend, and hold harmless HyperVoice and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Content you generate using the Service
11. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Disclaimer of Warranties, Limitation of Liability, and Indemnification) will remain in effect.
12. Modifications to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which HyperVoice operates, without regard to its conflict of law provisions.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and HyperVoice regarding the Service, and supersede all prior agreements and understandings.
